I go YAY and go to wait down at the gas station down the street and as I'm passing them the cop waves me down with the flashlight and makes me park in front of my friend. He gives us both a ticket for 82...wtf? and points out how he thinks my car is nice...It's my first ticket ever...the jerk couldn't give me a warning...instead he bumps up the speed by 5mph... I feel your pain :/
I feel you on this one completly!! I got pulled over for my first time 2years ago after moving to florida, for going 42 in a 40!! The "cop" thought the speed limit didn't reach over 35 on that road, I didn't argue, he gave me a warning for speeding, a warning for no seat belt, a warning for no proof of registration(which i had i just didn't know what it looked like becase i just moved from ohio and they are pink in ohio...and a ticket for no proof of insurance which i had on the car, but it wasn't my car so i didn't have the car, but it is still like damnn...This one time my fiance and I were on my lunch hour and he didnt believe me that there was a speed trap right around the corner so we took a drive around it, the cop said we were doing 65 in a 45 in our truck in a speed trap we knew about!! yeah right! lol..In florida if you get a speeding ticket you can go to driving school to get it off your recored, can you do that there?? if so it is worth it..

It's easy to talk shit on a message board about a "pig". I hope you never need that "pig".

I didn't say that ALL cops are "pigs" I just don't get where they get off with half the shit they said, and why they think they can walk up to our car and treat us like shit. They had no reason to talk down to us. We are all humans. Keep in mind. We were doing the speed limit, we were a safe distance from the car infront of us and I am pretty sure we were doing under the speed limit because we were still at a red light. Trust me I don't want a "pig" trying to help. I have the most up right respect for the good cops out there, I don't have respect for the ones that get all big eggo's just because they are a cop. I know people will take this the wrong way. I am sorry if you do, but I was venting..and that is what this lounge is for.

    Fla. Stat. 316.272

316.272. Exhaust systems, prevention of noise

    (1) Every motor vehicle shall at all times be equipped with an exhaust system in good working order and in constant operation, including muffler, manifold pipe, and tailpiping to prevent excessive or unusual noise. In no event shall an exhaust system allow noise at a level which exceeds a maximum decibel level to be established by regulation of the Department of Environmental Protection as provided in s. 403.061(11) in cooperation with the Department of Highway Safety and Motor Vehicles. No person shall use a muffler cutout, bypass or similar device upon a vehicle on a highway.

    (2) The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of excessive fumes or smoke.

    (3) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.

Unless it's hiding from me or I passed over it, Florida does not have a law against aftermarket exhaust systems as long as they are within the decibel limits basically.

I just went through all of the Florida Motor Vehicle statutes and only found the one above that would pertain to the situation, in which case, piggly wiggly did not subject the car to a decibel meter so I'd say you're clear of all the tickets.

And btw these are not criminal offenses, each one should be a non-moving violation and are simply civil tickets.

I'm in law school and have access to westlaw so that's where I got all the info

You are going to need to look VERY closely at your local statutes for exhaust systems. It's probably going to have verbage pertaining to "louder than stock equipped" or something like that. Hate to say it but they're probably going to get you on that. They don't have a leg to stand on considering the MT's are street legal. License plate will most likely end up as a fix-it, in which case you can show up with it unobstructed and get that tossed.

BIGGEST thing you have going is a witness as to the cops attitude about the situation.

    *edit*
Ryan and I are on the same lines here. What you NEED to do is find a decibal limit absolutely stated in teh statutes, then get your car tested at idle and various loads, and compare that to what the statute says. I'm betting that the statute doesn't even have a decibal limit listed, or if they do it's probably going to be an idle specification, or if you're lucky the DB limit pertaining to what the load is won't be specified, and you can easily walk away from that one.

Thank you sooo much!!!!! Do they have to use a decibel meter to give you the ticket? and Do they have use the meter 50 feet from the car? and if they do wouldn't passing vechicals confict with the results? He used a device "recording device" and stood within two feet of the car and walked around the car from drive door to rear to passenger door, and then said "Thank god I have this all on video" if you view my videos later I did exactly was the cop did just in reverse order and it was very loud on the video,I took a video of the exhaust from sitting in the car, and it doesn't sound as loud. Don't get me wrong the car is loud, but I don't know if it is too loud.

Thank you for all our help. When you become an attorney we will hire you!
