Well here is where we are at. Our fine country says that defendant have the RIGHT TO A SPEEDY TRIAL....
Meaning from.the moment my arrest paperwork is complete the should be in front of a judge for their actual trial (not the arraignment or preliminar) within a certain amount of time...
Well the defense had filed to challenge this amd me...saying that I did not afford him his rights and actually violated them by taking to.lomg to bring him to trial.
Which I do not disagree it took way to long... but that is because he TOOK OFF! HE SKIPPED ...HE WAS MIA... HE WAS ON THE RUN.
I did all I could with the resources I had. I work for a small dept and the defendant lives in another state... i filed an arrest warrant and even got approval from the county for extradition for most of the eastern US.
i made contact with the Atty Generals office as well as the State Police i the state he resides in to continue to attempt to make contact at the address where he resided.
No luck. I made contact with 3 different lawyers that he had utilized in the past.
No luck as he did not pay any of them and they had no contact. Even used addresses.to homes.i kmew to be vacant and attempted to.make appointments for him to come out and do estimates...he either no showed or sent other representatives...
Like i said...small PD limited resources a...and it was out of my control that he was on the run with a warrant out for his arrest.
Fast forward to a few months ago...we all meet in county court for them (defense) to challenge my violation of his right to a speedy trial. The defense atty... the assistant district atty and the judge spent alot of time in chambers talking.
I was later told that basicallu both sides are in fear of losing this challenge. If defense loses it... they know i have a greaf case and this is not his first time doing this. The ADA fears that if we lost this step...then my whole case is gone... and done.. (keep.in mind i worked this case since 2010 till current).
What they agreed upon (and needed my approval on).was if the defendant made full restitutiom his charges would be dropped to slaps on the wrist instead of the felonies... if he could only make partial restitution. The felonies would be dropped to misdemeanor (less serious) charges and he would still be court ordered to pay back the rest as stipulatiom to his sentence.... finally...if he did not come up with amything...we would recomvein in December and pick up.right here to have this hearing to challenge me amd the time it took.
Well...
IM PLEASED TO ANNOUNCE.MY VICTIM RECIEVED FULL RESTITUTION from.that pos.... (minus the actual cost that the work would have cost to have done) which im ok with...but it was a dhitty job amd I think he should have gotten all of his money back.
I hope the defendant sold equipment to get the money and did not scam others to do it... but the reality of it is... well YOU KNOW.
SO in conclusion even though I would have liked to see WILLIAM HARRISON of PROPAVING out of DE behind bars... my (now 91 or 92 year old victim has gotten most of his money back....

Well, good...fuck that guy. He also had Harrison's Paving which disappeared a few years ago...makes sense now with the previous conviction. They always had brand new trucks and equipment. He pissed me off years ago when I installed garage doors after a run in on a job site.
